VOLUNTARY SETTLEMENT OF COMMERCIAL DISPUTES

Nature of the procedure
The initiation of the procedure of assistance called “Letter of Assistance” is based on the written request submitted by any Bulgarian or foreign trader, containing details on the company, against which the claim is made, description of the circumstances on which the claim is based, the amount of the debt (if there is any), as well as any other information related to the arisen dispute.

If the request is made by a Bulgarian entity claiming against a foreign entity, then BCCI sends a letter to the relevant foreign chamber of commerce, which describes the case as presented by the Bulgarian party and the nature of the claim thereof. Referring to the arrangements of cooperation between chambers of commerce, BCCI addresses the relevant foreign chamber requesting it to render assistance to the foreign entity to undertake actions towards the amicable settlement of the dispute.

Similarly, if a foreign company lays claim against any Bulgarian partner, it addresses the foreign chamber, where that company is a member, and refers the case requesting assistance to the BCCI for the voluntary settlement of the dispute.

The above procedure is voluntary and based entirely on the good will of the parties to settle the dispute out of court.
