Agreement between BCCI, Sofia, and the FINNISH CENTRAL CHAMBER OF COMMERCE

"Disputes arising from or in connection with the contract shall not be subject to the jurisdiction of general courts of law but shall be settled by arbitration.

The following procedure shall apply with respect to the arbitration:

  • when the seller is a physical or juridical person of the Republic of Finland, the dispute shall be settled by the Arbitration in the Republic of Finland, the Rules of the Arbitration Committee of the Central Chamber of Commerce of Finland being applicable;
  • when the seller is a Bulgarian foreign trade organisation, the dispute shall be settled by arbitration which shall be held at the Arbitration Court of the Bulgarian Chamber of Commerce and Industry according to its Rules.

A counterclaim or set-off claim based on the same contract as the original suit shall be settled by the same arbitration tribunal in which the original suit is considered.

The arbitration award shall be final and binding upon the parties.

In the dealings between the parties the substantive law of the seller's country shall apply with respect to matters which have not been settled or have been settled insufficiently in the contract."
